Yes, federally. Under the 2018 Farm Bill, hemp and hemp-derived products containing less than 0.3% delta 9 THC on a dry weight basis were removed from the Controlled Substances Act. State law is where it gets complicated. A number of states have restricted or banned delta 8 specifically, and the list changes. Will Delta 8 Flower Make You Fail a Drug Test?
